GLLLP wins preliminary injunction for clients, compelling condo to repair clients’ apartment

GordonLaw LLP recently prevailed on a motion in New York State Supreme Court requiring high-end condominium The Cobblestone Lofts to take immediate steps to repair, at its expense, the apartment owned by the Firms’ clients, Shane and Marissa McMahon.  The Court, finding that GLLLP likely would prevail on the McMahons’ claims, also held that the McMahons likely would be harmed if the requested relief were not granted and that the balance of equities favored the McMahons over the Cobblestone.  Thus, the Court granted the relief that GLLLP requested.  Here’s the key language from the Order:  “Defendant The Cobblestone Lofts Condominium is directed to make all necessary repairs to the exterior of the building to stop and prevent the further infiltration of water into Plaintiffs Shane McMahon’s and Marissa McMahon’s apartment, at no cost to Plaintiffs besides the above-mentioned undertaking [of $2,500.00].”  And here’s a link to the decision:  http://www.nycourts.gov/REPORTER/pdfs/2017/2017_32118.pdf.
