Mike will speak to the key issues involved in the lead-up to expert testimony. Whether testifying on liability, causation or damages, expert witnesses can make or break a case. The outcome of trial often hinges upon the likability, credibility and communication skills of expert witnesses. Complex cases ordinarily do not even settle until after expert reports are submitted and experts have been deposed, providing a barometer for the likelihood of success at trial. For that reason, counsel must carefully vet whether a potential expert is the right fit for the case, and an analysis of the opponent’s expert and his or her opinions will help in determining whether any specific rebuttal experts are needed. Further, once an expert is selected, attorneys must prepare him or her for the upcoming case to ensure that he or she will not fall victim to any Daubert challenges, and also to ensure that the witness is prepared to testify at their deposition and trial. Further, counsel must identify any flaws in the opponent experts’ testimony and prepare a strategy for impeachment during cross-examination.
